1. About These Terms
These Terms of Service govern your use of Fashion Workplace, a job board platform connecting employers in the fashion industry with job seekers across Europe. By creating an account or using any part of the platform, you agree to be bound by these terms. If you do not agree, please do not use the platform.
Fashion Workplace is operated from the Netherlands. These terms are governed by Dutch law.
2. Service Description
Fashion Workplace provides an online platform where employers can list job opportunities and job seekers can discover and apply for roles at fashion brands. We act as an intermediary: we are not a party to any employment relationship between employers and candidates, and we do not guarantee that any listing will result in a hire, or that any application will receive a response.
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.
3. Account Registration
To post jobs or to access certain features as a job seeker, you must create an account. When registering, you agree to provide accurate and current information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old to create an account. Accounts are personal and may not be transferred to another person or organisation without our written consent.
We reserve the right to suspend or terminate accounts that violate these terms, including accounts found to be submitting fraudulent, misleading, or abusive content.
4. Employer Obligations
If you use Fashion Workplace to post job listings, you accept the following obligations:
You must ensure that every job listing is accurate, complete, and lawful. Listings must describe a genuine, currently open vacancy at your organisation. You may not post listings for roles that do not exist, that have already been filled, or that are intended to collect applicant data for purposes other than recruitment.
All listings must comply with applicable employment and equal opportunities law, including the prohibition of discrimination on the basis of gender, race, nationality, religion, age, disability, sexual orientation, or any other protected characteristic. Job listings may not include unlawful requirements or use discriminatory language.
You are responsible for handling applications you receive through the platform in accordance with applicable data protection law (including GDPR) and for responding to candidates in a timely and respectful manner.
5. Job Seeker Obligations
If you use Fashion Workplace as a job seeker, you agree to engage with the platform honestly and in good faith. Any information you submit in connection with a job application (including your CV, cover letter, or profile) must be accurate and not misleading.
You may not use the platform to engage in any form of commercial activity, including soliciting employers for services unrelated to legitimate employment.
6. Payment Terms
Job listings are subject to a posting fee as described on the pricing page at the time of purchase. All fees are displayed in Euros (EUR) and include applicable taxes where required by law.
Payment is processed by Stripe and is required upfront before a listing is published. Job posting fees are non-refundable once a listing has been published. If a listing is rejected for violating these terms before publication, any payment made will be refunded.
Each job listing remains active for 30 days from the date of publication, after which it expires and is removed from the public listings. Expired listings are not renewed automatically.
7. Intellectual Property
Fashion Workplace owns all intellectual property rights in the platform, including its design, code, branding, and original content. Nothing in these terms transfers any ownership rights to you.
By posting a job listing, you grant Fashion Workplace a non-exclusive, royalty-free licence to display, reproduce, and distribute the content of that listing on the platform and in communications related to it (such as job alert emails and search engine indexing). This licence ends when the listing expires or is removed.
8. Prohibited Content and Conduct
The following are strictly prohibited on Fashion Workplace:
Fake or misleading listings. You may not post job listings for roles that do not exist or that misrepresent the nature, location, salary, or requirements of the role.
Spam. You may not use the platform to send unsolicited commercial messages to other users, or to use automated means to interact with the platform in ways not expressly permitted.
Scraping. You may not use automated tools, bots, or scripts to extract content from the platform without our prior written consent. This includes scraping job listings, company information, or any other content.
Unlawful content. You may not post content that is defamatory, obscene, hateful, discriminatory, or otherwise unlawful.
Impersonation. You may not create an account or post listings while impersonating another person or organisation.
9. Disclaimer and Limitation of Liability
The platform is provided on an "as is" and "as available" basis. Fashion Workplace makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on the platform, including job listings posted by employers.
To the fullest extent permitted by Dutch law, Fashion Workplace's liability for any claim arising out of your use of the platform is limited to the amount you paid to us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages, including lost profits or lost opportunities, even if we have been advised of the possibility of such damages.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other matter where liability cannot be limited by law.
10. Governing Law and Disputes
These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any dispute arising out of or in connection with these terms that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
If you are a consumer based in another EU member state, you may also be entitled to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.
11. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the "last updated" date at the top of this page. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
